The Terms and Conditions define the basic rules that will be applied by PR Lotika, Belgrade, (hereinafter: the Seller) and the end user of the web store (hereinafter: the Customer) to ensure successful completion of sales transaction through Web store on the website www.happybdayjack.com

Every purchase of goods made through a web store is binding upon the Seller and the Customer, and cannot be cancelled or changed without the prior agreement of both parties.

The Customer undertakes to follow the following steps during the ordering/purchase of the goods through the Seller’s Web store:

1. Product selection

2. Choosing the model of the product

3. Registration or entering personal data

4. Review of all the information, control and acceptance of order and General terms of use and purchase.

5. Order completion

6. Payment through the selected payment method

7. Delivery of the goods

The Seller is obliged, upon receipt of the order/completion of purchase, to send an e-mail to the Customer with an order confirmation containing the model, color, price and the quantity of ordered product(s), the total amount for payment, the chosen payment method, as well as the delivery address details specified by the Customer.

The Customer is obliged to provide the Seller with the exact information for delivery of the goods (name and surname, full delivery address, contact telephone and E-mail of the Customer). If the Customer provides incorrect or incomplete information, the Seller cannot be held liable for problems in the delivery or taking over the ordered goods. In addition, the Seller shall not be liable for any problems arising from the delivery by the authorized courier service nor any problems arising from (non)acceptance of the goods by the Customer. In such cases, if the goods are returned to the Seller’s address as undelivered, the Seller shall also be entitled to charge the costs of failed delivery (dispatch) of the goods to the Customer on the occasion of the next attempt of delivery.

Products and Availability

While the Seller makes every effort to ensure that the photographs displayed on the website are faithful reproductions of the original products, including adopting every technological solution possible to minimize inaccuracies, variations may occur due to the technical and colour resolution characteristics of your computer and the handmade nature of the products, and the uniqueness of each individual product. The Seller shall not be liable therefore for the eventual inadequacy of the graphic representations of products displayed on the site owing to the above mentioned technical and production circumstances.

The Customer acknowledges that the products offered by the Seller are subject to stock limits. The Customer may check the availability of any item offered on the website any time. Any item when selected that shows the sign “Sold out” is not available. Inconveniences may occasionally occur regarding the availability of certain products. In such circumstances, the Seller will inform the Customer of this fact as soon as possible (and in any case within the term of delivery as specified below) by e-mail or telephone. The Seller will give the Customer the option to order a different item of the same type or alternatively, to cancel the order. Should the Customer opt to cancel his/her order no charge will be made to his/her credit/debit card. In the event that the credit/debit card has already been charged, the Customer will be refunded as soon as possible, subject to Raiffeisen bank and Customer’s bank processes, that are beyond the Sellers’s control.

The Seller reserves the right to change the items offered on the website at any moment, without prior notice. The Seller reserves the right to change the terms of use and purchase depending on the change in the offer of its services and (or) applicable legal regulations. The Customer is obliged to check the information regarding the business terms and terms of purchase on the Website prior to each purchase. By using the site, the Customer agrees to the General terms of use and purchase, which is confirmed by the purchase.

The Seller reserves the right to reject orders from any Customer with whom there is an ongoing legal dispute regarding a prior order. This applies equally to all cases in which we consider the customer unsuitable, for instance in the case of previous violations of terms and conditions for online purchases on the website or for whatever other legitimate reason, especially where the customer has been involved in irregular activity of any kind.

Price of products and delivery charges

HappyBdayJack website contains a large number of Products. It is always possible that, despite Seller’s efforts to the contrary, some of the Products on our site may be incorrectly priced. If the Seller discovers an error in the price of the Product he is obliged to inform the Customer of this error and to give the Customer the option of continuing to purchase the Product at the correct price or alternatively cancel the order. If the Seller is unable to contact the Customer using the contact details provided during the order process, the order will be cancelled and the Customer will be notified you in writing. 

Delivery and payment

HappyBdayJack products purchased via the website can be paid using all valid payment cards.

Payment for the Products and all applicable delivery charges are paid in advance.

In case the Customer makes a payment of an amount less than the total amount of the purchase order, it will be considered that the purchase is not completed and the paid amount will be returned to the Customer.

Serbia:

Delivery is made through PostExpress courier service of the Post of Serbia throughout the territory of Serbia. Orders are dispatched within maximum of 5 working days (usually one day after the order has been placed).  Customer will be provided with the tracking number, so he/she can “track and trace” his order anytime he likes. For tracking, please follow the link.

Should the Customer desire the goods to be delivered to him otherwise (by personal takeover or by using another courier service), it is necessary to inform the Seller via E-mail.

The costs of delivery to the address shall be borne by the Customer, according to their valid price list. Please see the valid PostExpress price list of the Post of Serbia on their official website.

From the moment of taking over of the shipment by the courier service, full responsibility is assumed by the delivery service, and the Seller shall be exempt from liability related to possible delayed shipments, the time of shipment delivery and damage to shipments occurred during transport.

International shipping:

In case of export, products may be subject to customs clearance procedure, incl. all applicable fees (custom duties) and related indirect charges (DDU (Delivery Duty Unpaid) Incoterm applied.

Pursuant to the applicable Law on Consumer Protection (Official Gazette of the Republic of Serbia No. 62/2014 and 6/2016), please be informed on the following:

The Customer shall be entitled to withdraw from the contract without specifying the reason thereof within 24 hours of placing the order into the basket (before the payment is made), after which the product will be returned to the stock and the transaction will not be realized.

The shipment of products abroad is done by means of postal service for international consignments – PostExport of the Post of Serbia. Delivery is made within 10 business days as from the date of consignment dispatch for the territory of Europe, or 15-20 business das for other parts of the world. Customer will be provided with the tracking number, so he can “track and trace” his order anytime he likes. For tracking, please follow the link.

The Seller shall not be liable for any fees that may arise as a result of customs and tax regulations in the country of destination. Please check the customs and tax regulations in the country where you receive the shipment before ordering.

The costs of delivery to the address shall be borne by the Customer.

Returns policy

Considering its sensitivity and hygiene measures of our Company and specifics of the product, once you have made the purchase, you cannot return the underwear item. All measurements and info for the featured products can be found in the product description section so please check before buying.

Events outside our control i.e., Force majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control.

An ‘Event Outside Our Control’ means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

  • we will contact you as soon as reasonably possible to notify you; and
  • our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

For all disputes between the Seller and the Customer which cannot be settled by mutual agreement and in the spirit of good cooperation, the Court in Belgrade shall have jurisdiction.
